在新形势下,以深入推进三项重点工作为载体,强化公诉环节诉讼监督职能意义重大。但司法实践中,基于公诉人司法角色的错误定位、诉讼监督职能的制度保障不完善、相应工作的考核机制不科学等等原因,导致了诉讼监督职能的弱化。本文针对在公诉环节中开展诉讼监督所存在的问题进行分析,并针对存在的问题提出相应的解决对策,以期在公诉环节诉强化讼监督职能,促进公正廉洁执法。
Under the new situation, in order to further promote the three key tasks as a carrier, it is of great significance to strengthen the litigation supervision function in public prosecutions. However, in the judicial practice, due to the wrong orientation of the prosecutor’s judicial role, the imperfect system guarantee of litigation supervision function and unscientific examination mechanism of the corresponding work, the supervision function of litigation is weakened. This article analyzes the problems existing in litigation supervision in the public prosecution session and puts forward corresponding solutions to the existing problems so as to strengthen the litigation supervision function and promote fair and honest law enforcement in the prosecution chain.
