文章认为,商业秘密的特性有5个,即秘密性、独占性、新颖性、实用性、效率性。除此之外,所谓的经济性、价值性、无形性、管理性、合法性等观点都值得商榷。目前商业秘密流失的渠道较多,而在职人员的“跳槽”则是其中的主要渠道。要解决“跳槽”人员与商业秘密保护的矛盾,一靠加强法律规范来解决,二靠贯彻“三兼顾”原则来解决。在解决中,一定要保护涉密人员的切身利益
