本文以保障公诉案件被害人诉讼权益立意,探讨我国现行法律法规对被害人诉讼权益保障不足,笔者综观关联文献并联系诉讼实践,从十个方面提出完善“公诉案件被害人”诉讼权益保障的建设性意见。即落实被害人人身安全保护,扩大并落实被害人知情权,被害人及时获得律师代理,完善公诉转自诉保障起诉权,赋予被害人上诉权,完善被害人抗诉规定,完善被害人再审申诉规定,落实被害人国家救助,构建被害人社会援助,完善精神损害赔偿制度。
In this paper, to protect the rights and interests of victims in public prosecution cases, this paper discusses the current laws and regulations of our country and protects the rights and interests of victims. This article summarizes the related literature and links litigation practice, and puts forward the constructiveness of perfecting the protection of the rights and interests of litigants in public prosecution cases from ten aspects opinion. That is, to implement the personal safety and protection of victims, expand and implement the victim’s right to know, to promptly obtain the lawyer’s assistance, to improve the prosecutorial power of public prosecution, to grant the victim the right of appeal, to improve the victim’s protest requirements, to improve the victim’s appeals, to implement the aid and construction of victims Victim social assistance, improve the system of mental damage compensation.
