自2007年7月1日《劳动合同法》颁布到2008年1月的正式实行,再到5月《劳动合同法实施条例草案》的意见征求,用人单位对该法均有了较深的了解,也在不断完善自身的管理制度、工作流程,为创造和谐劳动关系做着积极的努力。然而,劳动争议案件的发生数量却并没因此而大幅减少,因违法解除劳动合同而引发的争议案件反而有所攀升。分析发现,用人单位在解读该法时,普遍存在断章取义的现象,忽视了部分法条规定的解除程序,并为此付出了双倍经济补偿的赔偿,从而使法律成本的支出大幅增加。本期“甲方乙方”栏目专家将通过典型案例,对劳动合同解除程序及争议点作出分析,为解决用人单位出现的上述问题献计献策。
