在我国司法实践中,对于用人单位的原因导致的工伤事故,受害的劳动者只能主张工伤保险待遇,而对于第三人的原因导致的工伤事故,受害的劳动者既能主张工伤保险待遇又能向第三人主张民事赔偿。这种工伤保险与民事赔偿的衔接模式不能体现平等对待每一位劳动者。我国新的工伤保险法律法规规定的先行支付及追偿权为协调工伤保险与民事赔偿的衔接提供了借鉴。在工伤保险与民事赔偿的衔接上,采用“补充模式”可以避免受工伤事故伤害的劳动者获得额外的利益,同时应全面规定工伤保险的先行支付义务及对工伤事故的相关责任人员的追偿权,这样可以使相关责任人员承担相应的法律责任,并使劳动者在发生工伤事故后能获得标准统一的赔偿或补偿。
