标准化战略下的专利联营已成为全球专利技术贸易的主流模式,正引起各国反垄断执法机构的广泛注意。作为规制政策的最新表现,日本颁布的《关于标准化与专利联营的指南》提出了较为系统的反垄断分析框架。在对此学习与借鉴的基础上,我国应该一方面大力建设自主技术标准与专利联营,另一方面尽早建立针对性的反垄断规制政策。
The patent pool under the standardization strategy has become the mainstream mode of the global trade in patented technologies and is attracting the attention of anti-monopoly law enforcement agencies in various countries. As the latest manifestation of regulatory policies, Japan’s “Guidelines on Standardization and Patent Pools” put forward a more systematic antitrust analysis framework. On the basis of this study and reference, our country should vigorously build its own technical standards and patents on the one hand, on the other hand, as soon as possible to establish targeted anti-monopoly regulatory policies.
