《中华人民共和国侵权责任法》(以下简称《侵权责任法》)规定未尽到安全保障义务的管理人或者组织者、有过错的劳务派遣单位,未尽到管理职责的教育机构对他人侵权造成的损害承担“相应的补充责任”。究竟“相应的补充责任”归属于何种责任形态、应当如何适用,理论界与实务界有着不同的观点。为正确地适用法律,有必要对此进行深入研究与讨论。
