雇用活动中中受伤的雇员,关于工伤赔偿的问题,根据民事侵权法的传统理论,对雇主的赔偿责任,按照对一般民事侵权责任归责原则处理,即过错责任归责原则处理。我国《民法通则》对雇用活动中雇员受到的伤害怎么赔偿的问题目前尚没有明确的规定。在最高法院《人身损害赔偿司法解释理解与适用》出台之前,从我国各地法院的判例来看,有的法院采用过错责任归责原则,有的法院采用无过错责任归责原则。本文以雇员受伤雇主承担责任的真实案例浅析了雇员受伤案件中雇主的责任。
