近年来,动物园动物损害事件时有发生。2016北京延庆区八达岭野生动物园发生一死一重伤的动物伤人事件;2017宁波雅戈尔动物园发生一起老虎咬人事件。尽管《侵权责任法》对此作出相关规定,但在法律适用及理论研究上社会各界对有关动物园动物致人损害的侵权责任归责原则存在一定的争议。本文从动物园动物造成他人损害承担责任的立法实践、归责、立法和适用问题等方面进行分析,提出相应的解决办法和完善建议,以推动我国《侵权责任法》切实有效。
In recent years, zoo animal damage occurred from time to time. 2016 Animal Husbandry and Wounding Incident at Badaling Safari Park, Yanqing District, Beijing; Tiger Biting Incident, 2017 at Youngor Zoo, Ningbo, China. Although the Tort Liability Law makes relevant provisions, there is some controversy over the application of law and theoretical research on the principle of attribution of tort liability for damage caused by animals in zoos. This article analyzes the legislative practice, imputation, legislation and application of zoo animals that cause damage to others, and puts forward corresponding solutions and suggestions to promote the effective and effective “tort liability law” in our country.
