针对行政自由裁量权在行使过程中出现的一系列权力滥用问题,首先介绍了行政自由裁量权的定义及其特点,进而概括了行政自由裁量权的行使现状,分析了出现滥用行政自由裁量权的原因;并在此基础上提出规范行政自由裁量权行使的政策建议,即从法制和道德两方面“软硬”兼施,规范行政管理中自由裁量权的行使。
Aiming at a series of abuse of power in the process of exercising administrative discretion, this article first introduces the definition of administrative discretion and its characteristics, and then summarizes the status quo of the exercise of administrative discretion. It analyzes the reasons for abuse of administrative discretion On the basis of this, this paper puts forward some policy proposals that regulate the exercise of administrative discretion, that is, “both soft and hard” from both the legal system and ethics, and standardizes the exercise of discretion in administrative management.
