著作权法适用的领域之间存在质的差异,心理学、行业研究相关的新发现不断表明这种差异对著作权法而言已经难以忽视,对所有领域、所有创作者适用一套激励理论以及给予同一程度的经济权利保护,未必能促进相关领域的创作。而重要的版权制度在处理异质性(譬如不同类型的作品)时表现出显著的混乱。本文试图通过澄清作者、作品、受众三种易被混淆的标准,从著作权法的根本目的出发,建立一套以作者标准为核心的三步衡量法,以便于灵活而有效地确定权利的归属与范围,实现各领域的繁荣。
There are qualitative differences between the areas to which the copyright law applies. New findings related to psychology and industry research continue to show that this discrepancy has been hard to ignore for copyright law, applying a set of motivational theories to all creators in all fields, The degree of protection of economic rights may not be able to promote the creation of related fields. Important copyright regimes display significant disruption in dealing with heterogeneity, such as different types of work. This article attempts to clarify the author, the work, the audience three easily confused standards, starting from the fundamental purpose of the copyright law, to establish a three-step measure with the author’s standard as the core in order to flexibly and effectively determine the ownership and Scope, to achieve prosperity in all fields.
