资源提供者(出资人、购买人)对宗教活动场所主张所有权的问题,主要是出资或者提供资源是否就意味着出资人或者资源提供者能够取得对宗教活动场所的所有权。司法实践大胆创造,阐明了包括寺庙道观等宗教活动场所在内的民间非营利组织的法律地位和特征,提出了资源提供者(出资人、购买人)不取得包括宗教活动场所在内的民间非营利组织的所有权的规则,在个案中直接面对并解决了资源提供者与民间非营利组织之间的产权界定难题。需要在出资不取得产权规则的前提下从民事立法或民间非营利组织的单行法的角度整体考虑解决包括宗教活动场所在内的民间非营利组织的法律地位、资源提供者的权利与义务、资源提供者与此类组织的关系以及此类组织的内部治理结构和外部行为方式等问题。
