国际商事仲裁是由当事人主导的仲裁,理应具有仲裁的私人性和保密性的特征。但近距离考察发现并不支持这一推论。事实上,国际商事仲裁的保密性近年才成为仲裁研究的前沿热点问题。
International commercial arbitration is a party-led arbitration that should have the characteristics of arbitration’s privacy and confidentiality. However, close examination found that does not support this inference. In fact, the confidentiality of international commercial arbitration in recent years has become the forefront of arbitration research hot issues.
