社会主义法治以权利本位为根本价值取向。人民主权和保障人权的基本法治原则都要求公民拥有普遍而广泛的权利。社会的权利文化和公民的权利意识,决定法治发展的水平。社会主义法治在立法、执法和司法阶段的运行,社会主义法律在各个领域的贯彻,社会主义法治与时俱进的发展,有赖于公民对权利的行使和运用。在新的历史时期,社会主义法治应当更加注重权利分配,推动社会公平正义的实现。
The rule of law in socialism takes the standard of rights as the fundamental value orientation. The principle of popular sovereignty and the basic rule of law guaranteeing human rights all require citizens to have universal and extensive rights. Social rights culture and citizen’s rights awareness determine the level of rule of law development. The operation of the socialist legal system in the legislative, law enforcement and judicial phases, the implementation of socialist laws in all fields and the development of the socialist rule of law with the times depend on the exercise and application of the rights of citizens. In the new historical period, the socialist rule of law should pay more attention to the distribution of rights and promote the realization of social fairness and justice.
