[案情简介]原告:江×被告:某工商局第三人:赵×、刘×、黎×等1998年6月,由原告江×、第三人黎×等人组建成立中创公司。2000年9月,该公司法定代表人死亡,其在公司的股权由第三人刘×继承。同年10月,在其他股东未参加的情况下,第三人黎×、刘×、赵×(非股东)召开中创公司股东会,由黎×主持会议,经投票选举,黎×、刘×以52%的表决权选举赵×为中创公司法定代表人。此后,中创公司向被告某工商局申请变更法定代表人及股东,并提交相应文件材料。12月15日,被告经审查,核准了中创公司法定代表人及股东的变更登记,法定代表人变更为赵×,并核发了法定代表人为赵×的企业法人营业执照。原告江×对被告为中创公司进行法定代表人变更登记行为
