2007年,“重庆最牛钉子户”事件让中国的城市化建设中出现的开发商和拆迁户之间的矛盾成为全国关注的话题。有人认为,如此之多的“钉子户”的出现是中国法治的进步。但是,笔者对此观点却比苟同。笔者认为,“钉子户”在各地的涌现并不是中国法治的提高,而只是社会和传媒的自由化后,人民大众对关乎个人利益的关注提高了。真正的法治进程的提高应当是政府、开发商和拆迁户都能够严格依照法律的规定,自觉合法地完成拆迁这一关乎城市建设的大事。
In 2007, the “event of the most cattle and nails in Chongqing” caused the contradiction between developers and relocatees in China’s urbanization to become a topic of national concern. Some people think that the emergence of so many “nail households” is an improvement of the rule of law in China. However, I agree with this view. The author believes that the emergence of “nail households” in various places is not an improvement of the rule of law in China. Only after the liberalization of society and the media, people’s concerns about personal interests have been raised. The real progress of the rule of law should be that the government, developers and relocatees all can strictly accomplish the demolition related to urban construction in accordance with the law.
