近年社会上存在一个现象,相关权力部门对企业、对个体户、对农民有名目繁多的摊派,有各种各样的罚款没收,中央、国务院三令五申“减负”,效果却不明显,甚至反而越减越重。这种现象在某些地区。在基层已达到成为严重影响经济发展,影响政府与群众关系的重要原因。该现象的存在,原因是国家机关(绝大部分是行政机关)权力滥用所致,这已是共识。笔者认为,从制度上寻找原因的话,则是由于收入权与支配权未能分离。
