法制既意味着善法之治,更意味着人们的普遍道德观念以及终极的价值理念,法治不仅仅是冰冷的规则与制度的结合。所谓的法律道德化,也就是将人类的道德原则以法律的形式确定下来,社会的法制也是在这个基础上产生的。而法律的道德化指的是法律成为整个社会最高的道德义务以及道德责任,能够成为社会大众心目当中的普遍信仰,道德的法律化和法律的道德化从一定程度来讲是相互统一相互作用的两个过程,在人类社会的发展过程当中想要进一步地实现法治则必须经过这两个历程,从这个角度来看,无论是道德的法律化,还是法律的道德化,都是人类社会进步的标志是人类社会发展的必经之路。
