我们曾就国际上对专家系统的版权保护作过讨论(参看本刊1993年第5期)。那次讨论,主要引用了我国《著作权》杂志翻译的材料。1993年《著作权》杂志第4期又进一步翻译了有关专家系统和专家系统知识库的保护的文章(吴海涛翻译),而且引述了荷兰的一个案例。根据这篇译文的材料,可以看到欧洲国家对待专家系统的保护,存在着一种矛盾的状况:既承认专家系统需要有法律保护,但又认为法律很难明确给它以保护。说得直截了当一些,那就是:实际上有需要,操作上有困难。为什么会有这样的情况呢? 为什么不能用一般的软件保护方法直接套用到专家系统上呢?
We discussed the international protection of copyright in expert systems (No. 5, 1993). That discussion, the main reference to China's “Copyright” magazine translation materials. In 1993, Copyright No. 4 further translated the article on the protection of expert systems and expert system knowledge bases (translated by Wu Haitao) and quoted a case of the Netherlands. According to the material in this translation, we can see that European countries treat the protection of the expert system in a contradictory situation. They not only recognize that the expert system needs legal protection, but also think it is hard to be clearly protected by law. To put it bluntly, that is: in fact there is a need, there are operational difficulties. Why is there such a situation? Why not use the general software protection methods applied directly to the expert system?
