实现社会和谐,建设美好社会,始终是人类孜孜以求的一个社会理想,也是党十六届四中全会提出的治国理政方略。毋庸置疑,社会和谐的前提是法律的和谐,法律和谐的关键是立法、司法和执法的和谐。而刑事防范工作,其根本目的在于预防犯罪,为和谐社会提供一个安宁的社会环境。笔者认为,在和谐语境下构建科学的刑事防范体系,可以从犯罪情报收集与共享,建设平安社区和新农村,以及转变执法人员执法观念、发动群众等三个方面进行制度创新与完善,在手段与方式上更多地体现出和谐的语境,这样既能有效地达到预防犯罪,减少社会不和谐的声音的目的,同时又促进我国和谐社会主义建设。
To achieve social harmony and build a beautiful society has always been a social ideal pursued by mankind. It is also a strategy for governing the country and administration put forward by the Fourth Plenary Session of the Party’s 16th Central Committee. Undoubtedly, the premise of social harmony is the harmony of law. The key of law harmony is the harmony of legislation, judicature and law enforcement. The basic aim of criminal prevention is to prevent crime and provide a peaceful social environment for a harmonious society. The author believes that building a scientific criminal prevention system in a harmonious context can innovate and improve the system from three aspects: collection and sharing of criminal intelligence, building safe communities and new countryside, changing the law enforcement concept of law enforcement officers and mobilizing the masses. Means and ways to more harmoniously reflect the context, so that we can effectively achieve the purpose of crime prevention, reduce the voice of social disharmony, while promoting the building of a harmonious socialist China.
