市场经济必须贯彻公权力不与民争利的原则。在市场经济里,公权力和私权利应是什么关系呢?李克强说,公权力是没有授权即禁止,而对于私权利来说,是没有禁止的即自由。也可以说,公权力没有授权的就是非法,私权利没有禁止的就是合法,市场主体的权利是天生的不是政府给予的。而公权力是来自授权,只有法律授权范围内它才是合法的。把权力关在笼子里,就是要拿出权力的清单。只有在权力清单里规定的才是合法的权力,超出了权力清单的范围都是违法的。
