公用企业是国家为适应社会公众生活而设立的经济组织,其公共利益性和不同程度的自然垄断性特征形成了公用企业的垄断传统。然而政企不分、缺乏竞争的事业化管理体制使公用企业与社会公益目标相背离,对我国市场经济建设和消费者权益造成了诸多不良影响。有效规制公用企业垄断,首先要实行政企分离,赋予公用企业独立的法人资格;其次要引入竞争机制,实行分业经营;最后要健全竞争法律制度,规范公用企业市场行为。
Public enterprises are economic organizations established by the state to adapt to the social public life. Their public interests and varying degrees of natural monopoly form the monopoly tradition of public enterprises. However, regardless of the difference between government and enterprises, the lack of a competitive career management system makes the public enterprises deviate from the goal of public welfare, which has caused many adverse effects on the construction of market economy and the rights and interests of consumers in our country. Effective regulation of public monopoly, the first separation of government and enterprises, to give public enterprises an independent legal personality; followed by the introduction of competition mechanisms, the implementation of separate operations; Finally, we must improve the legal system of competition, regulate public enterprises market behavior.
