法律文化是人类法律实践中创造的文化,包括法律规范,原则,法律意识,法律组织和设施,法律运作过程和方式,法学教学和法学研究。本文对中西方法律文化的社会条件和根本精神以及各自的特点进行了对比和分析,旨在吸取西方国家法律文化中的精华,去其糟粕,丰富我国法律文化,构建有中国特色的法治体系,从而为构建有中国特色的社会主义和谐社会奠定基础。
Legal culture is the culture created in human legal practice, including legal norms, principles, legal awareness, legal organization and facilities, legal operation process and method, legal teaching and legal research. This paper compares and analyzes the social conditions and the fundamental spirit of Chinese and Western legal cultures and their respective characteristics, aiming to draw on the essence of the legal culture in Western countries, to go to the dross, enrich our legal culture, construct the rule of law system with Chinese characteristics, Thus laying the foundation for building a harmonious socialist society with Chinese characteristics.
