1、根据中外合资经营企业法及其有关法律法规规定,外商投资企业只能出口本企业自产产品和进口本企业所需的机器设备和原材料、零部件等,除按规定经有关部门批准外,不得收购或代理其他企业的产品出口,也不得进口商品在国内销售或串换。 2、外商投资企业出口的产品,凡涉及出口许可证的,必须先经外贸部批准,年出口数量不得超过许可证商品年度出口计划、不允许外商投资企业向外贸公司买证出口,一经发现,要对买卖双方给予处罚。 3、中外合资、合作经营企业中方投资者分得的外汇,应严格按照《中外合资、合作经营企业中方投资者的外汇管理规定》结汇和上缴。要防止部分外贸企业通过其开办的外商投资企业出口激流外汇。 4、各地在兴办和审批外商投资企业时要继续把兴办产品出口企业作为工作重点,读励和支持企业扩大出口创汇,做到外汇收支平衡,逐步提高出口产品的原材料、零部件国产化率。
