在我国文化事业蓬勃发展的今天,各类作品的著作权保护愈来愈受到重视,但是由于职务作品的复杂性和特殊性,其作者权益常被人们所忽视,继而难以实现法律的保护。我国在对职务作品著作权保护制度方面虽然有着详细的规定,却依然存在着欠缺,同时,现有的制度已难以适应当下职务作品的发展与保护。在此,笔者将依次分析职务作品著作权保护的必要性、职务作品概念、我国现行法律的具体规定和存在的不足,提出对于职务作品著作权保护制度改善的几点建议。
Nowadays, with the rapid development of cultural undertakings in our country, the copyright protection of all kinds of works is paid more and more attention. However, due to the complexity and particularity of office work, the author’s rights and interests are often neglected by people, and then it is hard to realize the legal protection. Although there are detailed provisions on the copyright protection system of job works in our country, there are still some shortcomings. At the same time, the existing system has been difficult to adapt to the development and protection of current job works. Here, I will analyze in turn the necessity of copyright protection of job titles, the concept of job titles, the specific provisions of existing laws in our country and the existing shortcomings, and put forward some suggestions on the improvement of the copyright protection system of job titles.
