“集体所有制”的内涵不仅包括内部产权安排,而且涵盖着诸如人员关系、生产经营方式、利润分配等诸多方面的内容。企业“集体所有制”的属性判别由此展开,并在产权关系上突破了民法上关于“集体所有”的规定性。合作社的特征符合“集体所有制企业”的内在要求,且其财产权利安排暗合马克思关于公有制表现形式的经典论断。合作社“劳动群众集体所有制”属性由此证成。
The meaning of “collective ownership” includes not only internal property rights arrangements but also various aspects such as personnel relations, modes of production and operation, profit distribution and so on. The discrimination of the enterprise “collective ownership ” started from this and broke the stipulation of “collective ownership ” in the civil law on property rights. The characteristics of cooperatives are in line with the inherent requirements of “collective-owned enterprises” and their property rights arrangements are in line with the classic Marxist theory of public ownership.
