国际法发展呈现价值多元化的趋势。国际法首要和基本的价值是维护国际和平与安全。传统国际法追求的是国家价值,即独立、平等、自治、领土完整和不可侵犯等,集中表现为主权原则。现代国际法日益关注个体的人的权利,强调人的价值。在国际法的发展上表现为人权的普遍化与国际化及国际法规则的人本化。中国需要坚持国家主权原则以维护国家利益,而人权保护和国际法的人本化又与“以人为本”、“和谐世界”不谋而合。
The development of international law presents a trend of diversified values. The primary and fundamental value of international law is the maintenance of international peace and security. The traditional international law pursues the values of the state, that is, independence, equality, autonomy, territorial integrity and inviolability and so on, and concentrates on the principle of sovereignty. Modern international law increasingly focuses on individual human rights and emphasizes human values. The development of international law is manifested in the universality and internationalization of human rights as well as the humanism of the rules of international law. China needs to uphold the principle of state sovereignty in order to safeguard its national interests while human rights protection and the humanism of international law coincide with “people-oriented” and “harmonious world.”
