随着互联网的不断发展,人们对于网络的侧重和依赖不断加深,主要体现在于网络花费的时间和金钱的数量逐年递增,随之产生的是虚拟财产的纠纷不断增多,现实中已出现大量关于虚拟财产的诉讼,在虚拟财产方面我国法律仍存在许多空白。而本文旨在以虚拟财产的继承为视角来探析虚拟财产的法律属性,虚拟财产继承与用户协议的冲突,并通过对目前虚拟财产继承保护提出一些建议。
With the continuous development of the Internet, people focus on and deepen their dependence on the network, mainly due to the increasing amount of time and money they spend on the Internet. As a result, the number of disputes over virtual property has been on the rise. In reality, Property lawsuits, there are still many gaps in the law of our country in terms of virtual property. The purpose of this paper is to explore the legal nature of the virtual property, the conflict between the virtual property inheritance and the user agreement from the perspective of the inheritance of the virtual property, and put forward some suggestions on the inheritance and protection of the current virtual property.
