为了维护社会主义法制的统一,立法法对全国人大及人大常委会与国务院之间、中央与地方之间的立法权限划分做出规定。立法法的颁布实施,对于防止重复立法、越权立法、无效立法起了重大作用。本文重点研究行政机关立法权产生的理论根据、立法权限界定的科学机制、行政立法权限的范围问题。
In order to safeguard the unification of the socialist legal system, the legislative law provides for the delineation of the legislative authority between the NPC and the NPC Standing Committee and the State Council and between the central government and the local government. The promulgation and implementation of the Legislation Law played a significant role in preventing duplication of legislation, overrule of legislation and invalid legislation. This article focuses on the theoretical basis of the legislative power of the executive authorities, the scientific mechanism defined by the legislative authority, and the scope of the administrative legislative power.
