拒执罪行为的表现形式多种多样。所以,还需要对拒执罪的立法解释和新司法解释规定的拒执罪行为进行分类而加以整体把握,分别界定其行为起始日。该两解释规定的情节严重能够构成拒执罪的拒执行为,根据其行为可能发生的时间可以区分为两类:一类是在裁判生效之后执行程序启动之前和执行程序中均可能发生的拒执行为,另一类是只能在执行程序中发生的拒执行为。
