公共租赁住房是实现公民住房权的一种重要保障,其需要各个效力层级的法律予以规定使其形成一套完整的公共租赁住房法律保障制度,以便相应公民的住房权能最终实现。在缺乏统一立法的情况下,各个地方在探索的过程中形成了特色鲜明的地方模式。总体而言,我国公共租赁房的法律保障机制仍然存在严重的不足,唯有通过宪法、法律、行政法规的综合体系方能建构完善的保障机制。
Public rental housing is an important guarantee for the realization of the housing rights of citizens. It requires the law of various levels of effectiveness to stipulate that it should form a complete system of legal protection for public rental housing so that the housing rights of the corresponding citizens can finally be realized. In the absence of uniform legislation, various localities have developed distinctive local modes during their exploration. In general, there is still a serious shortage of legal protection mechanisms for public rental housing in our country. Only through a comprehensive system of constitution, laws and administrative regulations can a sound guarantee mechanism be constructed.
