新加坡原属英联邦国家,深受英国法律的影响,是普通法系国家。新加坡的法律渊源及主要依据:新加坡共和国宪法;被接纳的英国法令;新加坡国会制定法令,即成文法或称制定法;新加坡法庭的判例,即法官造法;有关部长根据法令拟定的辅助条规,即附属法规;国际公约;风俗习惯①。本文主要从这些渊源入手,对新加坡的法律渊源做简要的分析和介绍。
Originally a Commonwealth country, Singapore is deeply influenced by English law and is a common law country. The legal origins and main grounds for Singapore are: the Constitution of the Republic of Singapore; the English Act Accepted; the Legislative Decree of the Singapore Parliament, the statutory or statutory law; the judgments of the Singapore courts, that is, the law of the judges; the statutory provisions that the Minister has drawn up under the Act, Subsidiary laws, international conventions, customs and habits ①. This article mainly from these sources, the legal origin of Singapore to do a brief analysis and introduction.
