当前我国侵权责任法对于医疗器械侵权仅规定了不真正连带责任这一种责任形态,但拘泥于《侵权责任法》第59条,仅以不真正连带责任对待医疗器械侵权无法化解现实疑难问题。本文将以植入类医疗器械这一最具有代表性的医疗产品为研究对象,集中分析医疗器械的责任形态,同时,针对《侵权责任法》的相关规定进行解析,提出相关设想。
At present, China's Tort Liability Law only stipulates a form of responsibility that is not really joint and several liability for medical device infringement. However, it is rigidly adhered to Article 59 of the Tort Liability Act. It is unable to resolve the difficult problems of actuality by treating the infringement of medical devices only with no real joint and several liability. In this paper, we will focus on the most representative medical products of implanted medical devices as the research object, focus on the analysis of the responsibility forms of medical devices, and at the same time, analyze the relevant provisions of the Tort Liability Act and put forward relevant ideas.
