1996年正式实施的《澳门刑法典》对保安处分作了全面具体的规定。与大陆法系其他国家或地区不同的是 ,澳门刑法中的保安处分无论是在内容上还是在形式上都有自身的特点。从保安处分的种类、保安处分的适用原则以及保安处分与刑罚的关系三个方面阐述了澳门刑法中的保安处分规制内容 ,并在此基础上对其立法进行了评析。
The Criminal Code of Macao, which was formally implemented in 1996, provided comprehensive and specific provisions on security measures. Different from other countries and regions in the civil law system, the security penalties in the criminal law of Macao have their own characteristics both in content and in form. This article expounds the content of security regulation in Macao criminal law from three aspects: the types of security measures, the applicable principles of security measures and the relationship between security measures and penalties. On this basis, the legislation of the security system is also analyzed.
