集体土地征收过程中,由于被征收人及征收关系人的各项权利保障不到位,尤其是对知情权的保障不足,知情不全面、知情不及时甚至无法知情的现象普遍存在,导致在土地征收过程中权利主体的程序权利和实体权益经常受到严重侵害。然而,由于现行土地征收法律制度对被征收人及征收关系人权益保障的制度规定不完善。加之维权救济途径的限制,导致权利主体的合法权益受到侵害后无力伸张,甚至转而采取非理性的维权方式,最终使得征地矛盾日益尖锐并严重化,征地矛盾成为市场经济发展过程中阻碍经济建设及社会发展的毒瘤。我国现行征地法律制度对集体土地征收的规定不够完善,尤其是有关土地征收的程序性规定有待进一步细化。对被征收人及征收关系人知情权法律保障的不足,导致权利主体的合法权益无法得到伸张和保护。据此,应当加强对土地征收制度中知情权的研究,为法律制度完善和权利人权益保障提供借鉴。

The lack of legal protection of the expropriated person and the acquisition of the right to information of the related party results in that the legitimate rights and interests of the right main body can not be extended and protected. Accordingly, the study on the right to information in the system of land expropriation should be strengthened to provide reference for improving the legal system and protecting the rights and interests of the right holders.
