相关市场是反垄断法中的基本概念。相关市场的界定是特定市场行为竞争分析的基础。相关市场包括相关产品市场、相关地域市场、相关时间市场。相关市场界定的一般方法包括需求价格交叉弹性方法、合理可替代性以及SSNIP(假定的垄断者测试)检验方法。相关市场界定中缺乏界定相关市场的证据制度、缺乏界定相关市场的案例指导制度、缺少界定相关市场的专业执法机构。故提出在我国反垄断法中确立相关市场界定的具体依据、设立独立和专业的执法机构和实行相关市场界定的案例指导制度。
The relevant market is the basic concept of antitrust law. The definition of the relevant market is the basis for a competitive analysis of a particular market activity. The relevant markets include the relevant product markets, the relevant geographic markets and the relevant time markets. Common methods of defining the relevant market include a demand-price cross-elasticity approach, a reasonable substitutability, and a SSNIP (hypothetical monopolist test) test. There is a lack of evidence in the relevant market definition to define the relevant markets, lack of case guidance to define the relevant markets and lack of specialized law enforcement agencies to define the relevant markets. Therefore, it puts forward the specific basis for establishing the relevant market definition in our antitrust law, establishing independent and professional law enforcement agencies and implementing the case guidance system defined by the relevant market.
