国际上认为偷渡旅客,是指在任何港口或该港附近地点未经船舶所有人,或船长,或管理船舶的任何其他人员的同意,而潜入船内,并在该船驶离上述港口或地点后留在船上的人(引自《关于偷渡旅客的国际公约》第一条)。这是国际上给偷渡旅客下的定义。通俗的说,偷渡旅客是未经船上任何人员同意而躲在船内并驶离该港口的人,这也是我们通常说的偷渡犯。船方发现船上潜有偷渡旅客,首先要查明他的上船港,或该港附近的地点。然后按照有关的规定,船方应将偷渡旅客看管起来,不准他下船,以便将他遣送士岸,送交适当机构.所谓适当机构,是指港口所在国政府授权处理偷渡旅客的机构。我国则是港口主管机构和边防检查站。在将偷渡旅客送交适当机构时,船长须向该机构呈递一份经过签字的报告,其中应写
