民事执行检察监督的正当性与合理性

民事判决、裁定执行难的原因,除了执法的社会环境、执行体制存在问题外,执行程序缺乏有效的监督机制是其根本原因。而民事执行检察监督的建立具有正当性和必要性,从执行权角度来讲,当前民事执行现状及监督机制缺乏是检察机关监督民事执行的合理依据;从检察机关角度来说,其符合宪法关于人民检察院的功能定位,是权力制衡理论的要求。

The reasons for the difficulty of civil judgments and rulings are the fundamental reasons for the lack of an effective oversight mechanism for enforcement procedures, except for the social environment for enforcement and the enforcement system. However, the implementation of civil enforcement procuratorial supervision is justified and necessary. From the perspective of executive power, the current civil execution status and the lack of supervision mechanism are the reasonable bases for procuratorial agencies to supervise civil execution. From the viewpoint of procuratorial organs, The function orientation of the People's Procuratorate is the requirement of the balance of power theory.
