Arthur von Mehren is a well-known expert on comparative law and has had an influential “civil law system.” As a member of the U.S. delegation to the Hague Conference, he played an important role in drafting the convention on the validity of international jurisdiction and extraterritorial awards. This article mainly describes the drafting process of this convention and the main controversy of delegates. The author believes that the draft can provide a convenient and useful framework for the consultative process, and many of its provisions can be adapted slightly to a more loosely coupled mixed convention that allows for different outcomes.
