有身份者与无身份者共同职务犯罪的罪名认定在理论和司法实践中均存在较大争论,本文从分析有身份者与无身份者在共同职务犯罪的分工类别出发,讨论不同类别职务身份犯共犯的罪名认定问题。
There is a big controversy in both theoretical and judicial practice in regard to the conviction of having a joint job crime with status of identity and no status. This article analyzes the relationship between identity status and non-status category in the division of labor of common duty crime, Accomplices convicted of the problem.
