禁止性出口补贴一直是世界贸易组织中被各成员国广泛关注的议题,并经常成为争端的焦点。但是对禁止性出口补贴实质要件的认定标准并没有明文化,需要由争端解决机构根据个案来判断,因此造成认定上的不确定。在研究相关案例的基础上,详细分析禁止性出口补贴的实质要件,并探讨多哈回合中禁止性出口补贴的实质要件可能的发展趋势。
The prohibition of export-oriented subsidies has always been a topic of concern to member countries of the World Trade Organization and has often been the focus of disputes. However, the criteria for determining the substance of the prohibition on export subsidies are not clearly defined and need to be judged by the dispute settlement body on a case-by-case basis, thus resulting in uncertainty about the determination. On the basis of studying relevant cases, the author analyzes in detail the essential elements of the subsidy for export prohibition and discusses the possible development trend of the substantive elements of the prohibition of export subsidies in the Doha Round.
