2004年宪法修正案对公民合法的私有财产的保护,无疑是一种进步。但近年来屡见不鲜的拆迁问题,又将财产权问题推向风口浪尖。要保护被拆迁人的合法的财产权,就须先理解宪法的相关规定。本文由2011年兰州市对17户钉子户的起诉案开始,从财产权的发展脉络及各国宪法对财产权的普遍规定入手,探求我国宪法对财产权保护的立法原意,并指出相应不足,以期更好地解决问题。
The protection of the legitimate private property of citizens by the 2004 constitutional amendment is undoubtedly an improvement. However, in recent years, the common problem of demolition and relocation of property rights has been pushed to the cusp. To protect the legitimate property rights of the demolished people, we must first understand the relevant provisions of the constitution. This article begins with the prosecution of 17 nails families in Lanzhou City in 2011. Starting with the development of property rights and the general provisions on property rights of various countries, this article explores the legislative intent of our country’s constitutional protection of property rights and points out the corresponding deficiencies in order to better Solve the problem.
