世界各国反垄断法对自然垄断行业的适用是循序渐进的,自然垄断行业竞争水平的变化,根本上决定了反垄断法对自然垄断行业是否适用以及适用的范围。当前我国的自然垄断行业大体上已经处于垄断与竞争并存的阶段,区别于传统的自然垄断,因此一般适用于反垄断法。此时,在自然垄断行业,如何协调好反垄断法规制与行业监管之间的关系显得尤为重要。
The application of antitrust law in natural monopoly industries in various countries of the world is gradual and orderly. The changes in the competition level of natural monopoly industries fundamentally determine whether antitrust laws apply to natural monopoly industries and the scope of their application. At present, China’s natural monopoly industries are generally in the stage of coexistence of monopoly and competition, which is different from the traditional natural monopoly. Therefore, it is generally applicable to the anti-monopoly law. At this moment, in the natural monopoly industries, how to coordinate the relationship between the antitrust laws and regulations and industry regulation is particularly important.
