1945年2月2日的法令确立了未成年人刑法和成年人刑法之间的明确区别。因循这条法令,逐渐形成了一种禁止在强制基础上对未成年犯采用教育手段的司法理念。然而,从20世纪90年代开始,另一种司法手段取而代之。未成年人司法在保持自我特性的同时,表现出对公共秩序的更多关注,并发展出一种对少年犯的新教育理念。在这种理念里,教育并不排斥法律约束。同时,少年犯在犯罪行为中的刑事责任尽管被减轻,但依然被认为是存在的。作者还分析了2006年秋季呈交给议会的关于预防犯罪的法律草案,他认为这份草案呈现出与传统司法指导原则的一种断裂。
The decree of February 2, 1945 establishes a clear distinction between juvenile and adult criminal law. Following this decree, a judicial concept of prohibiting the use of educational means against juvenile offenders has gradually been formed. However, another kind of judicial measure has been replaced since the 1990s. While maintaining its self-identity, juvenile justice has shown more concern with public order and has developed a new educational concept of juvenile offenders. In this philosophy, education does not exclude legal constraints. At the same time, the criminal liability of juvenile offenders for crimes, though mitigated, is still considered to exist. The author also analyzes the draft law on crime prevention submitted to the Parliament in the autumn of 2006, which he believes presents a break from the guiding principles of traditional justice.
