我国《物权法》第21条规定了不动产登记机关登记错误,致他人损害,登记机关应负赔偿责任。本文认为该条规定过于原则,在今后制定不动产登记法中应进一步细化。文中指出应结合中国现阶段的实际情况,明确登记行为的行政行为性质,确定登记机关的国家赔偿责任,探索国家赔偿机制与保险机制相结合的道路,构建符合我国国情的不动产登记制度,以保障人民的财产权利,维持正常的交易制度。
Article 21 of China’s “Property Law” stipulates that the registration of real estate registration errors, resulting in damage to others, the registration authority shall be liable for compensation. This article believes that the article provides too much principle, in the future development of real estate registration law should be further refined. The article points out that we should combine the actual situation in China at present stage, clarify the nature of the administrative act of registration, determine the national compensation liability of the registration authority, explore the road of combining the national compensation mechanism with the insurance mechanism, and establish a registration system of real property in line with China’s national conditions. People’s property rights, to maintain a normal trading system.
