商业贿赂是一种十分普遍的犯罪现象,不仅滋生腐败、败坏风气,而且严重扰乱经济秩序,破坏公平竞争的市场原则。从我国查处的商业贿赂案件来看,被动受贿占多数,一些主动索贿者往往也是从被动受贿开始走上犯罪道路的。严惩商业贿赂,净化市场环境,建立防治商业贿赂犯罪的长效机制,是从源头上治理腐败、深化行政管理体制改革、构建社会主义和谐社会的重大举措。
