人员租赁法律关系和基础德国人员租赁适用于《劳动法》和《人员租赁法》。《人员租赁法》70年代就有,但2004年1月又进行了修改。主要内容有四条:1.申请租赁许可;2.禁止涉足建筑行业;3.对租用时间的规定;4.对价格的规定。德国法律规定,人员租赁业不能涉足到建筑行业,其目的是保护建筑工人的利益,这不是人员租赁公司的愿望。根据此法律规定,人员租赁公司经营必须经过许可,租赁公司首先要提交申请,联邦调查局会同当地劳动局核
