十八届三中,四中全会中均对行政执法程序的规范提出相应要求,为使行政权被约束而进一步提出政府权力清单制度。我国检察权的性质大多出现于刑事领域,对于行政执法的监督并不严格。当前的行政检察监督存在三方关系矛盾,监督之后,立法分散,方式匮乏等多方困境,但大量的实践经验说明,行政检察监督的存在是切实必要的,其不仅能促进立法的完善,还能使得权力之间实现相互制约,公共利益得以维护,完善当前的行政检察监督机制的多方构建,亟待进行。

However, a large number of practical experiences show that the existence of the administrative procuratorial supervision is actually necessary and can not only promote the improvement of legislation, but also enable The mutual restraint of power, the maintenance of public interest, and the improvement of the multi-party construction of the current administrative procuratorial supervision mechanism are urgently needed.
