宋广新是江苏省沭阳县沭城镇农民,2009年春,他在沭阳新沂河中捞鱼时,从河底捞出两把手枪。意外的收获使他惊喜异常,便悄悄拿回家中收藏起来,家中无人时还拿出来玩玩。后来,宋广新听说私藏枪支是犯罪行为,开始忐忑不安。2009年11月19日,他主动到当地公安机关投案,并将两支手枪上缴。经鉴定,该枪可正常发射,具有杀伤力,属《中华人民共和国枪支管理法》所称枪支。
