随着人类生活三维时代的到来,商标制度也正在经受着从传统二维商标保护向三维立体商标保护的转变。我国于2001年正式将立体商标作为我国商标法保护的客体。其显著性的认定一向是我国司法实践中的一个难题。为此,本文通过以近期立体商标注册案例为切入点,分析了我国司法实践对于立体商标显著性认定的不足,并提出了以获得显著性为主的三维显著性认定模式。
With the advent of three-dimensional human life, the trademark system is also undergoing the transformation from the traditional two-dimensional trademark protection to the three-dimensional trademark protection. China formally adopted the stereoscopic trademark in 2001 as the object of the protection of our trademark law. The determination of its salience has always been a difficult problem in our judicial practice. Therefore, this article analyzes the shortcomings of the judicial practice of our country in identifying the obviousness of the three-dimensional trademark by taking the recent cases of registration of the three-dimensional trademark as the starting point, and puts forward the three-dimensional salient recognition mode that takes the salience as the main.
